Welcome to The Art Influencer. These Terms & Conditions explain your rights and responsibilities when exploring, purchasing or selling original artwork, fine art prints and custom creations through our marketplace.
01. Acceptance of Terms
By accessing, browsing, registering on, or using The Art Influencer website, you agree to comply with these Terms & Conditions and the policies applicable to your activity.
These Terms should be read together with our Privacy Policy, Delivery Policy and Returns & Refunds Policy.
If you are registering as an artist or seller, additional seller-specific agreements and policies may apply.
02. Marketplace & Seller Roles
The Art Influencer is an online platform designed to connect art enthusiasts, collectors and buyers with original artwork and creative products.
Independent artists and approved sellers may offer their artwork through the marketplace. Each seller is responsible for providing accurate product information and fulfilling applicable obligations.
Where artwork is sold directly by The Art Influencer, the platform’s role as the seller will be identified.
The marketplace’s responsibilities remain subject to applicable Indian consumer protection and e-commerce laws.
03. Accounts & Eligibility
Customers and sellers are expected to provide accurate and current information when creating accounts and using website services.
- Keep your login credentials confidential.
- Use accurate contact information.
- Do not impersonate another individual or business.
- Notify us about suspected unauthorised account access.
- Comply with applicable laws and platform policies.
We may restrict or suspend accounts where there are legitimate concerns involving fraud, unlawful activity or serious violations, subject to applicable law.
04. Artwork Listings & Authenticity
Sellers must provide truthful and accurate information about their artworks.
- Artwork title and artist attribution.
- Materials, medium and dimensions.
- Original artwork or reproduction status.
- Edition information, where applicable.
- Framing and physical condition.
- Availability and applicable pricing.
Sellers must possess the necessary rights to offer the artwork for sale.
Counterfeit artwork, stolen products, unauthorised reproductions and misleading authenticity claims are prohibited.
05. Orders, Prices & Payments
Product prices are displayed on the website and may vary depending on the artwork, seller, dimensions, materials and customisation.
5.1 Pricing
The applicable checkout total should clearly show product charges, taxes, shipping costs and any additional mandatory fees before order confirmation.
5.2 Payments
Online payments may be processed through authorised third-party payment service providers.
Payment verification and transaction confirmation may be required before order processing.
5.3 Order Availability
If an artwork becomes unavailable after an order is placed, the customer will be informed and any collected payment will be handled according to applicable consumer law and refund obligations.
06. Custom Artwork & Commissions
Customers may request personalised or commissioned artwork according to the services available on the website.
Before a custom project begins, customers and the responsible artist should agree on relevant details.
- Artwork description and creative requirements.
- Dimensions and materials.
- Final price and applicable payment terms.
- Expected production and delivery schedule.
- Number of included revisions.
- Cancellation and change conditions.
Changes outside the agreed scope may require additional charges, subject to customer approval.
Personalised artwork may have special change-of-mind cancellation conditions. However, statutory remedies for defective, damaged, incorrect or misdescribed artwork remain applicable.
07. Shipping, Returns & Refunds
Delivery estimates, packaging arrangements, shipping charges and related conditions are explained in our Delivery Policy.

No provision in these Terms is intended to exclude mandatory consumer rights under applicable law.
08. Intellectual Property Rights
Artwork images, creative works, descriptions and other original content may be protected by copyright, trademark and other intellectual property laws.
Unless otherwise expressly agreed in writing, buying a physical artwork does not transfer copyright, reproduction rights or rights to commercially exploit the underlying work.
Users must not reproduce, redistribute, sell copies of, or commercially use protected content without the necessary permission.
09. Prohibited Activities
Customers and sellers must not engage in activities that compromise marketplace security, authenticity or fairness.
- Selling counterfeit or stolen artwork.
- Misrepresenting artists or businesses.
- Creating fraudulent orders or accounts.
- Manipulating reviews or product information.
- Misusing customer personal information.
- Infringing intellectual property rights.
- Engaging in harassment or unlawful conduct.
Violations may result in listing removal, account restrictions or other lawful action.
10. Complaints & Customer Support
If you experience problems involving an artwork, payment, seller, order or delivery, please contact our customer support team.
To help us investigate, include your order number, a clear explanation of the issue and relevant supporting information.
Customer complaints will be handled in accordance with applicable marketplace grievance redressal obligations.
11. Governing Law & Policy Changes
These Terms & Conditions are governed by applicable laws of India.
Any dispute resolution or jurisdictional provision is subject to mandatory consumer rights and competent legal authorities.
